CaRT to publish Judicial Review documents

THE Canal and River Trust (CaRT) states it will publish today (15 May 2014) court documents relating to the judicial review of its ‘Guidance for Boaters without a home mooring' (Justice Lewis slams ‘Guidance'), writes Allan Richards.

Publication of this information comes some 20 days after it was requested under the Freedom of Information Act, the maximum allowed by law.

The Trust has stated that its intention is to publish this information on its own website, (in response to the request) rather than make it publicly available via the Freedom of Information website, whatdotheyknow.com.

However, one document cannot be made publicly available for legal reasons due to copyright. This is the court transcript of the full hearing which CaRT can only make available privately to those requesting it (alternatively this document can be obtained from the transcription company for a fee).

Conflicting Press releases

With conflicting Press releases from CaRT and Nick Brown, the court documents will, no doubt, confirm what actually took place and what was said by Justice Lewis.

As was said in "Justice Lewis slams ‘Guidance'", time will tell.

[CaRT will be meeting boating user groups later this month to discuss the way ahead regarding enforcement. As far as is known, only the National Association of Boat Owners (NABO) has taken independent advice regarding CaRT's legal powers and polled its membership on this issue.]
